Flowering kale is used in the fall because it can handle frosts and actually gets better color after the cold temperatures hit. A hard freeze may hurt it, but these are tough plants and you can generally enjoy them until it's below freezing night and day. It won't overwinter in your garden, however, so just enjoy it for the season. Because it's a relative of broccoli and cabbage I would assume deer would dine on it if they could gain access to it.
